Cultivation and Distribution
Cultivation of ANY AMOUNT is a felony, punishable by 138-204 months in prison and a fine (determined by the judge).
Possession of any amount with the intent to distribute is a felony, punishable by 14-51 months in prison and a $300,000 fine.
Possession of any amount within 1,000 feet of a school is a felony, punishable by 46-83 months in prison and a $300,000 fine.
Furthermore, when someone is convicted of an offense punishable by mandatory minimum sentencing (MMS), under Kansas marijuana laws, the judge must use that sentence. The judge has no power to reduce or redefine the mandatory minimum.
