Montana has decriminalized marijuana for medical use but not recreational use. However, the laws are more relaxed than in some other states. Let's look at some of the consequences for possessing, cultivating and distributing marijuana.
Possession
Possession of 60 grams or less is considered a misdemeanor punishable by up to 6 months imprisonment and a fine of $100- $500. A second, or subsequent offense, is punishable by up to 3 years imprisonment and/or a fine up to $1,000. Furthermore, possession of more than 60 grams is a felony punishable by up to 5 years in prison, and/or a fine up to $50,000.
Possession of any amount of marijuana with intent to distribute is a felony punishable by up to 20 years imprisonment and/or a fine of up to $50,000. The law stretches further, noting that:
Cultivation and Distribution
Cultivation of up to 1 lb. or 30 plants of marijuana is a felony punishable by up to 10 years imprisonment or a fine up to $50,000
Cultivating more than 1 lb. (30 plants), you face a minimum of 2 years to a maximum of life imprisonment, and $50,000 fine. A second or subsequent offense for cultivation is punishable by doubling the prison term.
Distributing of any amount is a felony, punishable by 1 year to life in prison and a $50,000 fine.
Distributing any amount within 1,000 feet of a school is a felony, punishable by 3 years to life in prison and a $50,000 fine.
