Colorado Smoking Laws

The Law

Colorado smoking law states that it is unlawful for any person under the age of 18 to purchase or attempt to purchase tobacco or tobacco products. COLO. REV. STAT. ANN. § 18-13-121

  • It is illegal for minors in the state of Colorado (people under 18 years of age) to purchase tobacco products including cigarettes, cigars, and chewing tobacco.

  • It is illegal for a retailer to sell tobacco to a minor.

  • If a minor purchases a tobacco product, it is a class 2 petty offense.

  • If caught, the minor faces a $100 fine, or community service. The person who sold the tobacco to the minor has committed a class 2 petty offense as well, and will have to pay a $200 fine if convicted.

The Penalties

In Colorado, the penalties for minors using tobacco products are as follows:

Fine:

  • The minimum fine for minors using tobacco products is set at $100.
  • However, it is important to note that if you decide not to pay the fine, you have the option to attend a court hearing to challenge the citation.

Community Service:

  • In some cases, minors may be required to perform community service as part of the penalty.
  • It is worth mentioning that for each hour of community service completed, you may be eligible to receive a credit of $5, which can be applied towards the fine and court costs, up to 50% of the total amount.

Tobacco Education:

  • Additionally, minors may be required to enroll in a tobacco education program to further their understanding of the risks associated with tobacco use.

These penalties aim to discourage minors from using tobacco products and promote education and community involvement. It is important for minors to comply with these regulations to prioritize their health and well-being.
