The Law

Iowa smoking law states that it is unlawful for any person under the age of 18 to smoke, use, purchase, attempt to purchase, or possess tobacco products. IOWA CODE §§ 453A.2 (2003), 453A.3 (2004), 453A.56 (1991) & 805.8C (4)

The Penalty

In Iowa, there are specific penalties for minors caught using tobacco products. For a first offense, a minimum fine of $50 is imposed. Additionally, minors are required to complete 8 hours of community service as part of their penalty. This combination of a fine and community service aims to discourage tobacco use among minors while encouraging community involvement and responsibility.

For a second offense, the minimum fine increases to $100. In addition to the fine, minors must complete 12 hours of community service. This heightened penalty reinforces the importance of complying with the law and discouraging repeat offenses.

Subsequent offenses carry a minimum fine of $250. In such cases, minors are still required to complete community service, with the mandate set at 16 hours. It is worth noting that if the fine is not paid, minors have the option to attend a court hearing to challenge the citation.
