The Law

South Carolina smoking law states that it is unlawful for any person under the age of 18 to purchase, attempt to purchase, possess or attempt to possess tobacco or tobacco products; this includes falsifying one’s age to obtain tobacco. S.C. CODE ANN. § 16-17-500

The Penalties

Fine

  • A civil fine of $25

Community Service

  • May be required to complete 5 hours of community service

Tobacco Education

  • May be required to complete a smoking cessation and prevention program

Impact of Driver’s License

  • If minor fails to satisfy any of the penalties, he or she may have driver’s license and/or driving privileges suspended for 90 days
